Acceptable Use Policy

1. Purpose and scope

This Acceptable Use Policy ("Policy") governs your use of the 17100710 Canada Inc. ("Closynth", "we", "us", "our") platform and services (the "Service"). It is incorporated into and forms part of our Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service.

This Policy exists to keep the Service safe, lawful, and reliable for all users. By using the Service, you agree to follow it. We may update it from time to time as described in Section 8.

2. Your responsibility for content you upload

You are solely responsible for the Customer Content you upload to the Service. You must own, or have all rights, licences, and permissions necessary to use, the garment imagery and other materials you upload, and to have them processed by the Service. Do not upload anything you are not authorized to use.

3. Prohibited content

You must not upload Customer Content, or use the Service to generate imagery, that:

  • depicts a real, identifiable person, or that attempts to recreate, imitate, or approximate the likeness, face, or identity of any real individual, whether public or private;
  • infringes intellectual property rights, including copyright, trademark, trade dress, or design rights of any third party (for example, uploading another brand's product photography that you do not have rights to use);
  • depicts minors in any sexualized, exploitative, or otherwise inappropriate manner, or that constitutes or facilitates child sexual abuse material;
  • is sexually explicit, pornographic, or intended to sexualize a subject;
  • is unlawful, defamatory, hateful, harassing, discriminatory, or that promotes violence or illegal activity; or
  • contains malware or malicious code, or is designed to disrupt or compromise the Service or any system.

4. Prohibited uses and conduct

You must not:

  • reverse engineer, decompile, scrape, or attempt to extract the AI Models, underlying models, source code, or training data of the Service;
  • use the Service to build, train, or improve a competing product or service;
  • circumvent, disable, or interfere with any security, content-filtering, rate-limiting, or safety features of the Service;
  • resell, sublicense, share, or provide access to the Service to any third party, except as expressly permitted in the Terms of Service;
  • use automated means to access the Service in a way that exceeds reasonable use, overloads our systems, or violates usage limits;
  • misrepresent your identity or authority, or use the Service for any fraudulent purpose; or
  • use the Service in violation of any applicable law or the rights of any third party.

5. Content standards and third-party AI providers

The Service uses third-party AI providers to generate imagery. Your use of the Service must comply with the applicable usage and content policies of those providers, and we may enforce those policies through the Service.

Apparel imagery, including swimwear and intimate apparel, is permitted as legitimate commercial fashion and ecommerce product imagery. What is not permitted is sexually explicit, pornographic, exploitative, or otherwise inappropriate content, as set out in Section 3. We may apply content filtering, review, or additional safeguards to sensitive product categories to keep the Service compliant with our providers' policies and applicable law. We may decline to generate, or may remove, content that does not meet these standards.

6. Enforcement

We may investigate suspected violations of this Policy. Where we reasonably believe a violation has occurred, we may, at our discretion and without prior notice:

  • remove or disable access to offending Customer Content or Generated Output;
  • issue a warning;
  • suspend or limit your access to the Service; or
  • terminate your account, as set out in the Terms of Service.

We may also take any action required to comply with law or a lawful request, and to protect the Service, our providers, our users, and third parties. Serious violations, including those involving illegal content, may be reported to the appropriate authorities.

7. Reporting violations

If you become aware of any content or activity that violates this Policy, please report it to us at gen-abuse@closynth.com. We review reports and take action as appropriate.

8. Changes to this Policy

We may update this Policy from time to time. For material changes, we will provide notice through the Service or by email. Your continued use of the Service after the changes take effect means you accept the updated Policy.
